Conditions of Use
1. Scope and contractors
The following terms and conditions apply to orders of products from our online stores (www.decotoys.ch, www.vintage-toys.ch) in the respective drafting valid at the time of the order. The customer's contractual partner is the company Ramseier Handel und Vertrieb, Hinterdorfstrasse 17, CH-8542 Wiesendangen, Switzerland, Tel.: +41 52 558 21 47, email: info@decotoys.ch (hereinafter "Ramseier Handel und Vertrieb"). The Conditions constitute an integral part of the contract concluded between Ramseier Handel und Vertrieb and the customer. Deviations of the above mentioned conditions by other regulations are only binding legally, if they are expressly accepted in writing by Ramseier Handel und Vertrieb. Conflicting conditions of the customer in withdraw to our above mentioned ones are not recognized.
2. Delivery and sale
The price of shipping depends on size and weight of the package. Orders are usually shipped completely, but partial deliveries are possible. Ordered items will be delivered as soon as possible, subject to availability.
The usual delivery time is between 1 to 5 working days (excl. Shipping time, which depends on your choice (Priority Mail or Economy Mail) and your location. The delivery time starts when paying is fully completed. If an article is not available, we will inform the customer immediately. Customers shipping costs will be charged only once per order. Pre-paid amounts will be reimbursed for non-deliverable items. For products, that are not available in stock, the specified delivery time for the product applies. Risk: Shipping and transport are at the risk of the purchaser. The risk is gone to the buyer on dispatch of the goods, also if partial deliveries are made.
3. Order and conclusion of contract
The contract is accomplished by the fact that your order is accepted by means of our order confirmation. Receipt and acceptance of the order will be confirmed to the customer by email. Prior to the binding submission of his order, the customer can correct all entries using the usual keyboard and mouse functions. In addition, all entries will be displayed again in a confirmation window before binding the order and can be corrected by means of the usual keyboard and mouse functions. With the order confirmation, we will send you the text of the contract.
4. Offer
Our online offer is non-binding. Changes of color, appearance, texture and prices are subject to change. Technical modifications of articles, printing errors, price errors and availability are reserved. For any damage and subsequent damage that may occur during use or play mode, we assume no liability as an appropriate operation or play mode can not be controlled and monitored by us.
5. Price and payment
Our prices are ex warehouse and are shownby your choice in CHF, € or US$. Prices with an amount 0 (zero) or below the purchase price are erroneous and not binding. Payment is made via PayPal, credit card, postal order or bank transfer in advance.
6. Retention of title
The goods remain until full payment the property of Ramseier Handel und Vertrieb.
7. Warranty and liability
The warranty periods are governed by the statutory provisions and the general warranty by the manufacturer. This warranty does not apply to used items and improper handling of the product. There is no liability for damages through the use of the products.
8. Warranty
The guarantee of the purchased items at Ramseier Handel und Vetrieb is limited to the scope of the guarantee of the manufacturer. For used items, vintage items, as well as improper handling or personal engagement will void the warranty.
9. Data protection
Our Online Shop is encrypted using Secure Socket Layer (SSL), whereby all data of the offer and your billing and customer data will be securely transmitted to us. Each transaction is authorized online with the relevant credit card company. On your credit card statement, purchases are visible under Ramseier Handel und Vertrieb. The credit card number is not stored by us.
10. Miscellaneous
Should one or more provisions of these terms be invalid, this shall not affect the validity of the remaining provisions. Applicable is exclusively the substantive Swiss law. The application of the UN Convention on the International Sale of Goods (CISG) is excluded. Except for disputes arising from consumer agreements, the exclusive jurisdiction for all actions is the domicile of Ramseier Handel und Vertrieb. For disputes arising from consumer agreements, the court at the residence of the customer is responsible for customer complaints. Concerning complaints of Ramseier Handel und Vertrieb, the court of the customer must be responsible.
